Mount Kenya-West Bishop Joseph Kagunda
The Employment and Labour Relations Court in Nyeri area of Kenya
has fined the Anglican Church Kenya (ACK) Sh6.9 Million (N21) for
sacking three priests they suspected were homosexuals.
In a land mark delivery on Friday, Justice Bryam Ongaya ordered
that the three Men of God be reinstated from October adding that their
dismissal was unfair.
It would be recalled that in August 2015, Archdeacon John Njogu
Gachau, Rev James Maina Maigua and Rev Paul Mwangi Warui, were kicked
out of service on suspicion that they were engaging in homosexuality.
The Kenyans reported that the angry priests filed a suit at the Nyeri Court arguing
that Mount Kenya-West Bishop Joseph Kagunda had made up the gay story
with the intention of getting back at Archdeacon Gachau who had vied for
a church position that was won him (Bishop Kagunda).
The court ruled in favour of the three priests and ordered the
church to pay each of them Sh 2.3 Million as arrears for the lost
salaries while they were under suspension.
"An employer lacks power to find criminal liabilities of an
employee. The homosexual crime was not established in this court and
that notwithstanding there is no evidence of the homosexual
allegations," the judge noted.
